The complaint claims that the AI image generator Stable Diffusion contains billions of unauthorized copies of copyrighted images, which the companies use without the knowledge or consent of the original artists. Attorney Matthew Butterick, who previously represented developers in a case against GitHub Copilot, leads this legal challenge on behalf of the affected creators.
Stable Diffusion learns to create new artwork by analyzing scraped pairs of images and captions from the internet to identify themes and styles. The lawsuit argues that even if the final generated images do not directly resemble the original training data, the AI tool still inflicts permanent damage on the art market by flooding it with competing content. Butterick labels the unlicensed technology as a parasite that severely undermines the livelihoods of human artists.
The legal filing targets not only Stability AI for developing the model, but also DeviantArt for integrating the technology into its paid DreamUp application and Midjourney for operating its own text-to-image generator. The plaintiffs, including webcomic artist Sarah Andersen, seek compensation and injunctions through claims of direct and vicarious copyright infringement, DMCA violations, and breaches of contract. The case represents a major escalation in the ongoing legal battle between human creators and artificial intelligence companies.
