Elon Musk has filed a preliminary injunction in a California federal court to halt OpenAI's transition to a for-profit structure. The legal motion targets OpenAI, CEO Sam Altman, President Greg Brockman, Microsoft, and several former board members. Musk's attorneys argue that this injunction is necessary to prevent irreparable harm and preserve what remains of the organization's original nonprofit character.
The filing accuses the defendants of multiple illicit activities, including discouraging investors from backing rival AI companies like Musk's xAI. It also claims that OpenAI unfairly benefits from competitively sensitive information obtained through its tight partnership with Microsoft. Furthermore, the motion seeks to stop the transfer of OpenAI's intellectual property and assets as the company shifts its governance structure.
This legal action represents the latest development in Musk's ongoing battle against the AI startup he co-founded in 2015. Musk argues that the organization has abandoned its founding mission to make AI research freely available to the public, and he claims he was defrauded out of more than $44 million in early donations. The lawsuit, which now includes xAI and Neuralink executive Shivon Zilis as plaintiffs, follows Musk's initial dismissal of the case in July and its subsequent revival earlier this year.
