The department urges the automaker to comply without further enforcement measures while it waits for Tesla to submit a required site-specific safety plan. Under state law, operating in violation of health orders carries penalties of up to $1,000 per day or up to 90 days in jail.
Despite these legal threats, no agency immediately steps forward to enforce the shutdown order. The county sheriff defers responsibility to the Fremont Police Department, leaving local officers to determine how to handle the situation.
